1. GENERAL PROVISIONS AND DEFINITIONS
1.1. These terms and conditions (hereinafter: "Regulations") specify in particular:
1.1.1. the type and field of services provided electronically via the online educational platform available at: www.polskaszkolaonline.ie.
1.1.2 the conditions for the provision of services via the Portal, including technical requirements necessary for the proper use of the Platform,
1.1.3. conditions for concluding and terminating agreements for access to the Platform,
1.1.4. complaint procedure.
1.1.5. the rules for the processing of Users' data.
1.2. Users using the Portal are required to read the Regulations and comply with its provisions.
1.3. The Regulations are available at: www.polskaszkolaonline.ie
1.4. The terms used in these Regulations should be understood as:
1.4.1. Regulations - these Regulations;
1.4.2. Together-Razem - The Together-Razem Center is the managing body of the Polska Szkoła Online Akademia Razem project
1.4.3. Portal - an internet portal available at www. polskaszkolaonline. ie, run by the Foundation, through which the User can choose educational services,
1.4.4. Platform - educational platform for children "Polska Szkoła Online Akademia Razem" available at www.polskaszkolaonline.ie, administered and available to Users by the Foundation, which contains tools and content enabling the child's learning,
1.4.5. User - a natural person who is a consumer concluding an agreement with the Foundation for access to the Portal in the field specified in the Regulations, like a parent, legal guardian, or another person with full legal capacity; the use of the Portal by minors ("Child", "Children") is possible only with the consent of the legal guardian. Whenever these Regulations refer to a User in the context of the use of services provided by the Foundation, it should also be understood as children using the Portal with the consent of the legal guardian concluding an agreement with Together-Razem for access to the Portal;
1.4.6. Account - an electronic service, marked with individual access parameters given to the User by the system, in the form of a password and log in. The account is a collection of the User's data, in particular, information about access to Services, Orders, E-teaching records, and other functions
1.4.7. Registration System - an internet system used to register Users;
1.4.8. Educational services - access services to a Platform,
1.4.9. E-Recruitment service - includes a video interview with the student's teacher and the parent, which consists in assessing the child's competencies by an interview, tasks, and tests for assigning them to the appropriate class.
1.4.10. School education service - the category includes access to the entire platform with lesson scenarios, E-teaching records, Online Lessons, and Webinars
1.4.11. Lessons One to One service - a category of individual online lessons with the teacher, it is possible to purchase a single lesson or a package of 10 lessons
1.4.12. Additional classes - these are classes that constitute an addition to the curriculum, e.g. Journalism Club, Meetings with a book in the form of live meetings
1.4.13. School Year - the period of using the Platform from September 1 to June 30 of the following calendar year;
1.4.14. Fee - the cost incurred by the User for access to the Platform, as specified in point 6 of the Regulations;
1.4.15. Agreement on access to the Platform - an agreement for the provision of educational services or a sales agreement, depending on the subject of the agreement selected by the User
1.4.16. PayPal - PayPal provides an online account that allows you to easily send money from a variety of sources (such as credit card or bank account) to a wide audience (such as online stores or landlords) - without sharing your financial information.
1.4.17. Stripe - The Stripe system allows online payments by credit card
2. RULES OF USING THE PLATFORM
2.1. Access to the Platform "Polska Szkoła Online Akademia Razem" via the Portal is possible after registration using the Registration System, and then selecting the Educational Service, which is tantamount to agreeing on access to the Platform for the period of the School Year.
2.2. Conscious and willing registration via the Registration System is accepting the Regulations and placing an order which means signing the Agreement for access to the Platform.
2.3. Access to the Platform is possible for Users who:
2.3.1. have registered using the Registration System
2.3.2. have accepted the Regulations (checkbox),
2.3.3. have selected the option to purchase an Educational Service
2.3.4. made the payment in the selected form of payment,
2.3.5. provided the real details of the child: name, surname, and year of birth.
2.4. Access to the Platform is possible for Users who have paid the Fees.
2.5. Upon accepting the Regulations and placing an order, the User becomes a party to the contract for the provision of educational services with Together-Razem. Access to the Platform will be granted within 24 hours from the moment the payment is recorded to the Together-Razem account.
2.6. Access to the Platform is granted based on the User's data. After concluding the contract, the User is obliged to provide the following data: the child's name and surname, the child's year of birth.
2.7. Registration and the use of services through the Portal are voluntary. The condition for using the Platform is to provide complete and true data. It is forbidden for the User to provide illegal content, e.g. vulgar or offensive content, as well as to provide false data.
2.8. After performing the activities referred to in point 2.2 above, the User receives an electronic confirmation of the conclusion of the distance contract. Conscious and voluntary registration via the Registration System, accepting the Regulations and placing order results in the conclusion of an Agreement for access to the Platform.
2.9. The user is obliged to:
2.9.1. act in a manner that does not infringe the rights of other Users;
2.9.2. not disclose the User's data to unauthorized third parties;
2.9.3. not transfer the right to use the account to third parties, whether for a fee or free of charge;
2.9.4. use the Platform in a manner consistent with these Regulations, social and moral standards, general principles of using the Internet, including the use of the Platform in a manner that does not interfere with its functioning.
2.10. If the User takes actions that are considered by the Foundation to be undesirable if they are inconsistent with the provisions of these Regulations, or if they violate the rights of other Users, Together-Razem may notify the User by e-mail about this fact, requesting the cessation of such activities. If the User does not immediately comply with this request, it will be treated as a breach of the Regulations and may result in the blocking of the User's account and termination of the contract with immediate effect.
2.11. If the User's action referred to in point 2.8 above will constitute a violation of these Regulations, Together-Razem is entitled to terminate the User agreement for access to the Platform with immediate effect, which is tantamount to blocking the User's account. The termination is effective when Together Razem submits a declaration to the User. The termination will be sent by the Foundation to the User's e-mail address provided during registration in the Registration System. Items 8.4 - 8.5 shall apply accordingly.
2.12. A violation of these Regulations should be understood as a violation by the User of the provisions of points 2.6, 2.8.1 - 2.8.4, and 11 of the Regulations.
3. EDUCATIONAL SERVICES
3.1. Access to the Platform allows the User to use the educational services offered by the Foundation to the extent selected by the User
3.2. The purpose of educational services is primarily to educate children in the Polish language and knowledge about Poland, as well as to develop children's interests in Polish culture, tradition, geography, and history, and to provide them with information and knowledge in this field.
3.3. Educational services consist in educating Children with the help of a modern Educational Platform containing online lessons with the teacher, access to lesson scenarios, thematic webinar
3.4. Types of Educational Services:
3.4.1. Full school education service - includes full access to the platform for the period of the School Year with a one-time payment.
3.4.2. Instalment school education service - includes full access to the platform for the period of the School Year with a one-off payment
3.4.3. Lessons One to One service - a category of individual online lessons with the teacher, it is possible to purchase a single lesson or a package of 10 lessons
4. ACCESS CHARGES
4.1. The User places an order by selecting the Educational Service he is interested in adding to the basket and then selecting the payment method.
4.2. Together-Razem charges the User a Fee for accessing the Platform via the Portal. The fee is payable in advance in full or in the subscription system
4.3. The fee for access to the Platform for one School Year is as follows:
- Educational Service Full - € 380 for one person access. (commission of the payment system is € 10) A user residing in Great Britain pays a fee for access to the Platform in pounds sterling, for GBP 330 (the payment system commission is EUR 10 GBP)
- Educational Service Instalments - € 41 for access for one person per month (the payment system commission is € 2.20) - in this case, payment requires a subscription to PayPal
- One to One Lessons service - the service can be purchased separately or separately. The cost of 1 lesson (45 minutes) is € 40. When you buy a package of 10 lessons, the cost is lower and amounts to € 365
4.4. The User makes the Fees referred to in these Regulations through the Stripe or PayPal systems. The costs of commission of payment systems are covered by the User.
5. TECHNICAL REQUIREMENTS
5.1. To use the Portal's services, the User must meet the following minimum technical requirements
5.1.1. having a computer/laptop/tablet with a camera
- operating system: Windows® 7, 8, 8.1, 10, Mac OS X, Linux (all stable platforms);
- processor: 2GHz
- memory: 1 GB of RAM (for 32-bit system) or 2 GB of RAM (for 64-bit system);
- screen resolution: 1024 × 768;
- colour depth: 16 bit (high color);
- sound: sound card.
- graphics: DirectX 9 integrated video chip compatible with 128 MB RAM (separate 64 MB graphics card compatible with DirectX 9 recommended);
- browsers: Google Chrome, Safari, Mozilla Firefox, Opera
- add-ons: the latest version of Adobe® Flash® Player;
- cookie support: enabled;
- JavaScript: Enabled.
5.1.2. have minimum web environment requirements
- Internet access, preferably with a speed of at least 10 Mbps or higher for video files,
5.1.3. having additional devices: a webcam, speakers, and a microphone or a headset with a microphone
5.1.4. a standard file browser, including .pdf (eg AdobeReader), the ability to play audio and video files, an active e-mail address.
5.2. Together-Razem informs that when using the Portal, "cookies" are installed on the User's computer. The installation of files is necessary for the proper functioning of the Portal. The website uses session and persistent cookies.
5.3. Together-Razem is not responsible for:
5.3.1. the effects resulting from third parties gaining possession of the User's password, if the cause was not caused by Together-Razem;
5.3.2. providing Users' data to entities authorized under the applicable law, upon their request.
5.3.3. the quality of the User's internet connection
5.3.4. failure to meet the requirements specified in point 5.1 of the Regulations
6. CANCELLATION OF SERVICES (TERMINATION OF THE CONTRACT)
6.1. The User may resign from further use of the Platform access service at any time by submitting a declaration of termination of the contract. The termination is effective on the last day of the month in which the User made the declaration.
6.2. The termination notice should be submitted on the form, which constitutes Annex 1 to these Regulations, and sent by e-mail to the following address: info@together razem.org. The notice must be completed in capital letters, printed, signed, and sent by e-mail in the form of a scanned document or a good-quality photo of the document. The statement sent by e-mail is considered effectively submitted when it is sent by the User.
6.3. Submitting a declaration of resignation from further use of access to the Platform results in the removal of the User's account upon the expiry of the notice period indicated in point 6.1 above.
6.4. A User who has submitted a declaration of resignation from further use of the Platform access service has the right to a refund of the part of the Fee paid, calculated by point 6.5 below.
6.5. In the event of resignation from further use of the Platform access service, the User will receive a refund of the fee for unused months of education, reduced by the amount of € 20 - the cost of administrative services and bank fees and commissions to the User's bank account via a traditional transfer or via the PayPal payment system. The fee for unused months of education is determined by dividing the total cost of the purchased service by 10 months (the period of access to the Platform in the school year) and then multiplied by the number of months in the School Year during which the User will not use education due to the submitted resignation (for example: if the User has successfully terminated the contract in October, the amount paid is divided by 10 months (e.g. € 380/10 = € 38) and a part of the Fee is returned for the period from November to June (€ 38 x 8 = € 284 ) after deducting an additional € 20).
7. COOLING-OFF PERIOD - TERMINATION OF THE CONTRACT
7.1. The User may withdraw from the contract for access to the Platform without giving reasons by submitting a declaration of withdrawal from the contract within 14 days from the date of conclusion of the contract.
7.2. To meet the fourteen days referred to in point 7.1 above, it is sufficient to send a declaration of withdrawal before its expiry. The declaration may be in the form of an email sent to info@together-razem.org info@together-razem.org
7.3. Together-Razem shall refund the entire Fee paid for the purchased service not later than within 14 days of receiving the declaration of withdrawal from the contract.
7.4. The User is not entitled to withdraw from the contract in the case of the performed E- recruitment service and is not entitled to a refund of the Fee for this service.
8. PERSONAL DATA PROTECTION
8.1. The data controller is Centrum Together Razem, based in Cork, Ireland. Together-Razem Center is a non-profit organization registered with the Charity Authority in Ireland under the number and Company Registration Office. 8.2. In Together-Razem, the necessary procedures and safeguards have been implemented to ensure the correct processing of personal data. Together-Razem ensures compliance with the applicable data protection regulations.
8.3. Together-Razem processes Users' data:
8.4. to perform the education contract via the Internet Platform
8.4.1. to fulfill our legal obligations, such as keeping your billing records
8.4.2. against our legitimate interest in enabling ourselves to investigate and defend ourselves against claims on the part of the User,
8.4.3. against our legitimate interest in conducting direct marketing towards Users, in the form of providing information about the services offered,
8.4.4. Providing data is voluntary but necessary to use our educational services.
8.5. In the performance of the contract, the personal data of the User and his child will be transferred to the operator of the Platform on which the User's child is educated, they may also be transferred to entities providing hosting, IT, and e-mail services for Together Razem. In addition, the User's data may be transferred to entities providing accounting and marketing services for us. Because the administrator uses the "G Suite" e-mail, personal data may be transferred outside the European Economic Area to Google LLC with its registered office in the USA and to other third countries in which entities whose services are used by Google operate during the processing of personal data. Google is certified by the Privacy Shield and therefore guarantees compliance with European data protection law.
Personal data will be processed for the duration of the contract for the provision of educational services and the period of limitation of claims of the parties for breach of obligations under the contract, and to the extent that they are processed based on our legitimate interest until the User submits an effective objection to the processing. Moreover, the billing documentation will be kept for the period of limitation of tax liabilities resulting from the concluded contract.
8.6. The user has the right to access the content of personal data and requests their rectification, deletion, or limitation of processing, as well as the right to transfer data and the right to complain about the supervisory authority.
8.7. To the extent that we process the User's data based on our legitimate interest, the User has the right to object at any time to the processing of data due to his particular situation. The User also has the right to object to processing for direct marketing. They can be implemented by sending a message by e-mail or traditional mail to the above-mentioned correspondence addresses.
8.8. To provide the User with the highest level of security and protection of personal data, Together-Razem uses modern techniques of securing accounts and correspondence within the Portal.
9. COPYRIGHT
9.1. Copyright protects texts, graphics, diagrams, photos, sounds, presentations, films, and any other materials available on the Platform,
9.2. Any dissemination, modification, transmission, printing, duplication, public performance of Together-Razem materials beyond personal use is not permitted.
9.3. Each breach of the provisions of this section will constitute a gross breach of these Together-Razem Terms and Conditions, entitling Together-Razem to terminate the User agreement for access via the Portal to the Platform, tantamount to revoking the User from accessing the Portal.
10. COMPLAINTS
10.1. Each User has the right to file a complaint regarding the implementation by Together- Razem of the agreement on access to the Platform.
10.2. Complaints may be submitted by e-mail to the following address: info@together-razem.org or in writing by traditional mail to the address: Together-Razem Center. Unit 2A, Kilnap Business Park, Old Mallow Rd, Cork, Ireland.
10.3. The complaint should contain the User's name, surname, and correspondence address, an indication of what action or omission is the subject of the complaint, as well as a request for a complaint (e.g., refund of the Fee/part of the Fee, unblocking the User's Account).
10.4. The User will be informed about the method of considering the complaint in writing or via e-mail (depending on the form in which the complaint was submitted) immediately, but not later than within 30 business days from the date of its received by Together-Razem, subject to point 12.5. below.
10.5. Complaints about the operation of payment systems should be addressed directly to the administrators of these systems.
11. CHANGES TO THE REGULATIONS
11.1. Together-Razem is entitled to amend these Regulations.
The regulations may be changed, among others in case of:
11.1.1. changes to the applicable legal provisions, affecting the content of the Regulations;
11.1.2. changes related to the field and type of services provided by Together-Razem through the Portal;
11.1.3. changes in the technical requirements necessary for the proper use of the Portal.
11.2. Each change to the Regulations will be announced by posting a text of the amended regulations on the website www. polskaszkolaonline. ie/regulamin
11.3. The changed Regulations come into force after 7 days from the date of its announcement
11.4. A User who has concluded a contract for access to the Platform through the Portal, during the change of the Regulations, may resign from further use of the Platform access service by submitting a declaration of termination of the contract within 7 days from the date of the change.
12. FINAL PROVISIONS
12.1. All information about violations of the Regulations by Users should be sent to the following address: info@together-razem.org
12.2. Any questions or doubts related to the services provided by the Portal may be submitted in writing to the address of the Together-Razem Center. Unit 2A, Kilnap Business Park, Old Mallow Rd, Cork, Ireland, in person at the Together-Together office or via email info@together-razem.org
12.3. Together- Razem reserves the right to make changes to the Fees and/or Services on an ongoing basis and to carry out and cancel promotional campaigns. Any changes to prices and/or Services are effective from the moment they are introduced to the Regulations and do not apply to orders placed before their introduction to this system.
12.4. In matters not covered by these Regulations, the relevant provisions of generally applicable law shall apply.
12.5. This agreement is governed by the laws of Ireland. The choice of foreign law does not deprive the User concluding this contract of rights resulting from the mandatory provisions of the law of the country of their permanent residence in the territory of the European Union.
